TYPES OF PRODUCT LIABILITY

Product liability law is based on the principle that designers, manufacturers, and distributors must ensure the products they bring to market are safe for their intended use.

Three basic types of defects can give rise to a product liability claim in Pennsylvania:

  • Design defects – the product’s components or aspects of its design are faulty. These defects occur when a product’s design is incorrect or contains a flaw that poses an unreasonable danger to consumers.  These problems happen before the manufacturing process begins.
  • Manufacturing defects – the product received by the consumer did not follow the manufacturer’s specifications or was created below the standard of quality. These types of defects cover a wide range of issues, from inaccurate dimensions and surface imperfections to problems arising from subpar materials or errors during assembly.
  • Failure to warn – the manufacturer, seller, or distributor of a product does not adequately inform the user of the potential risks that may occur when their product is used. These claims are not based on a physical flaw or defect but rather that the creator of the product knew it posed a safety risk but did not appropriately inform their customers. 

Common Types of Defective Products

Defects and failures to warn can occur in almost every type of product that is sold today.  However, some of these issues occur in products where the likelihood of serious injury is much higher.  Some of the most common areas that we see faulty or unsafe products are:

  • Industrial equipment;
  • Construction site equipment;
  • Airbags or a lack thereof in vehicles;
  • Automobile safety designs;
  • Car seats for children;
  • Seatbelts and other safety devices;
  • Medical Devices; and
  • Pharmaceutical Drugs.
